NGT directs SDMC to take action against bakery running in residential area

The National Green Tribunal has asked the South Delhi Municipal Corporation (SDMC) and the SDM concerned to inquire and take action against an alleged illegal bakery being run in a residential area in Badarpur here.

A bench headed by NGT Chairperson Justice Adarsh Kumar Goel directed the SDMC and the SDM to look into the matter and take appropriate action in accordance with law.

"Allegation in this application is that the illegal bakery was earlier closed by the South Delhi Municipal Corporation in 2006 in the presence of the SDM, Kalkaji and Delhi Police. The same was started again...

"The applicant is directed to furnish a copy of this order, along with a complete set of papers to the SDM, Kalkaji and the SDMC for compliance," the bench said.

The tribunal was hearing a plea filed by Aslam Khan alleging that one Mohd Atif was operating an illegal bakery at house number C-282, Chungi No. 2, Ram Pyari Camp, Lal Kuan in Badarpur here without obtaining consent and permission of Pollution Department and other departments.

"The Tribunal vide order dated February 26, 2016... directed its closure from its location at RZ-3262-A, Street No. 36, Tughlakabad Extension, New Delhi-110019. Thereafter, the respondent no. 5 (Atif) has shifted to the present location but no action is being taken in spite of representations to authorities concerned," the plea alleged.

The tribunal had earlier ordered the closure of industrial units running in "non-conforming" residential areas and slapped a fine of Rs 50,000 each on the Delhi government and others for their "defaults and inaction" towards violation of rules.

It had directed the Delhi chief secretary to call a meeting of authorities concerned and seek an action plan to be prepared and implemented by a team comprising the DCP of the area, SDM and senior officer of Delhi Pollution Control Committee (DPCC). It noted that the said team must also conduct a public hearing on the spot at least once every week.
