The Delhi High Court on Thursday temporarily stayed the Chief Information Commission's (CIC) directive for an investigation into alleged irregularities and impersonation during an examination conducted by the Delhi Subordinate Services Selection Board (DSSSB). The DSSSB challenged the CIC's September 14, 2022 order, which was issued based on an appeal by Mahavir Singh.
Justice Sanjeev Narula issued a notice to respondent Mahavir Singh, with the matter scheduled for a hearing on October 21, 2024. Singh had filed an RTI application seeking the roll number and address of a candidate, information that was denied, prompting him to escalate the matter to the CIC.
On September 14, 2022, the CIC directed the DSSSB to investigate the irregularities alleged by Singh and take action against those responsible. During Thursday's hearing, DSSSB’s counsel, Avnish Ahlawat, argued that such directives were beyond the CIC's jurisdiction under the Right to Information Act, 2005. Agreeing with this contention, the court issued a stay on the order until the next hearing date.
