Delhi High Court Calls for Detailed Response on Transgender Recognition in Documents

A Division Bench consisting of Justice Prathiba M. Singh and Justice Madhu Jain, while examining several petitions, instructed that the Secretary of the Ministry of Social Justice and Empowerment be included as a respondent. The Centre is required to articulate its position through an affidavit within six weeks.

Concerns raised include the identification of transgender persons in certificates issued by institutions such as the University of Delhi and the CBSE. The Court further acknowledged that the outcome of this case might extend to other key documents such as birth and death certificates, passports, Aadhaar cards, and driving licenses.

During proceedings, representation for the CBSE cited the Transgender Persons (Protection of Rights) Amendment Act, 2026, emphasizing statutory changes defining a "transgender person." Petitioners argued the amendment's pending notification, maintaining compliance with the updated definition. To address the comprehensive impact, the Court authorized the Centre to engage additional ministries. Written submissions regarding the amendment's effects are to be filed by July 15, 2026.
