The Delhi High Court has ruled against providing age and attempt relaxations for candidates from the Economically Weaker Sections (EWS) seeking Central government jobs. The court asserted that these matters are strictly within the purview of government policy and found no constitutional violations in the existing framework.
In its decision, the bench highlighted the uniqueness of the EWS category, which is differentiated solely by economic disadvantages, unlike the SC, ST, and OBC categories that are based on historic and social disadvantages. Consequently, the court determined that EWS candidates do not have a right to claim the same relaxations as those made available to caste-based reserved categories.
The court also addressed claims of discrimination, underscoring that economic hardship can be temporary, whereas caste-based hardships are more permanent. Therefore, distinct considerations, like administrative feasibility and resource constraints, lying within the government's domain, do not breach constitutional equality. Thus, the plea was dismissed with no directives to alter current policy.
