The Allahabad High Court has nullified an order mandating permanent residency for e-rickshaw registration in Lucknow. The court ruled that this condition infringes on fundamental rights, including equality and freedom of occupation.
The decision was made by Justices Shekhar B Saraf and B R Singh, who heard four petitions, including one from Ajit Yadav. The petitioners opposed the residency requirement, questioning its legality.
While the state cited challenges in serving notices to non-resident e-rickshaw owners, the court dismissed this reasoning. It proposed alternative solutions to manage e-rickshaw numbers, emphasizing fairness and non-discriminatory regulation practices.
