The Supreme Court of India has issued a directive requiring high courts to deliver judgements within three months from the date of reserving the order, highlighting the significant impact of delays on litigants. The court emphasized faster resolution in cases concerning personal liberty.
Chief Justice of India Surya Kant and Justice Joymalya Bagchi outlined these directives following a plea about delays in judgement postings. They underscored the necessity for high courts to act quickly in cases involving regular bail, anticipatory bail, criminal appeals, and death sentences, ensuring decisions are pronounced promptly.
The Supreme Court specified that in bail applications, decisions should be announced immediately and that judgements granting bail must be communicated to the jail authorities and the trial court on the same day to facilitate prompt release. Where delays could cause irreparable harm, courts may issue an immediate order with a reasoned judgement to follow within 15 days.
To improve procedural efficiency, Chief Justices are instructed to adjust court websites to send automated reminders on pending judgements. If a judgement is not delivered within four months, the case can be reassigned to another bench. This initiative aims to enhance judicial accountability while respecting high court judges' discretion.
