The Delhi Police sought additional time on Saturday to file a necessary sanction under Section 195 of the Criminal Procedure Code (CrPC) against Sakariya Rajesh Bhai Khimji and Syed Tahsin Raza, both implicated in the Delhi CM attack incident.
The attack occurred during a Jan Sunvai event at Chief Minister Rekha Gupta's official residence in August, resulting in an FIR being registered at the Civil Lines police station.
Additional Sessions Judge Ekta Gauba Mann questioned the Special Public Prosecutor Pradeep Rana on how cognisance was taken without the sanction being filed. Rana mentioned that the sanction is pending with the home department but assured a supplementary charge sheet including the sanction will be submitted within two weeks. Subsequently, the matter for charge arguments is set for December 15.
Previously, Delhi's Tis Hazari Court scheduled the case for arguments on framing charges on November 10. The Delhi Police have already filed a charge sheet against the accused, and cognisance has been acknowledged. The police have also included sections for attempt to murder and criminal conspiracy in the FIR.
Appearing for the state via video conferencing, SPP Pradeep Rana, alongside advocate Kartik Gadi, reviewed the case status. The accused were arrested by the Delhi Police in October and remain in judicial custody. The attack on the CM, for which Khimji and Raza are charged, originated from an alleged incident during a public hearing at the CM's residence.
