Allahabad High Court Grants Bail, Reinforces 'Bail is the Rule'

In a significant ruling, the Allahabad High Court on Thursday granted conditional bail to Wasik Tyagi, who has been in custody for a year after being accused of disrespecting the Indian National Flag and posting pro-Pakistan content online. The court's verdict emphasized a crucial judicial principle: pretrial detention must not be punitive, even with serious allegations.
Tyagi's arrest followed a First Information Report (FIR) from May 16, 2025, in Charthawal, Muzaffarnagar, where he was accused of sharing a Facebook post that morphed the Indian flag onto a dog. His post, which praised Kamran Bhatti and included 'Pakistan Zindabad,' was argued by prosecutors to incite separatism and threaten national integrity. His initial bail request was denied in September 2025.
Despite the gravity of charges, Justice Rajiv Lochan Shukla granted the second bail plea, citing the Supreme Court's judgment in Syed Iftikhar Andrabi vs National Investigation Agency. The court emphasized 'bail is the rule, jail is the exception' as a keystone of the legal system, noting the critical aspects of fundamental rights and the prolonged delay in trial proceedings, which further justified bail under Article 21 of the Constitution.
