Karnataka HC Upholds Nutritional Rights for All Prisoners

The Karnataka High Court reiterated on Wednesday that all citizens and undertrial prisoners are entitled to a nutritious diet, irrespective of their social or financial status.

Justice M Nagaprasanna made this observation during a hearing on a petition filed by actor Darshan Thoogudeepa, who is currently jailed in the Renukaswamy murder case.

Darshan had contested a Magistrate court's decision to reject his request for home-cooked food in prison.

Senior advocate Prabhuling K Navadgi, representing Thoogudeepa, argued that the medical certificate indicated the actor required nutritional food.

Justice Nagaprasanna remarked, ''If a special diet is necessary due to health issues, doctors will provide it. This principle applies to every citizen or undertrial prisoner, regardless of status.'' The judge noted that medical needs would be met for everyone, whether a celebrity or not.

Navadgi argued that the Magistrate court misinterpreted Rule 728 of the Karnataka Prisons and Correctional Services Manual, 2021, which cannot override the Prison Act's Section 30. This section allows home-cooked food for undertrial prisoners with required approvals.

The court maintained Section 30's procedure, noting that the Prison Manual provides regulatory guidelines that are legally accepted.

Navadgi requested authorities to consider Darshan's request for home-cooked food and amenities objectively, in consultation with a medical officer.

The Special Public Prosecutor informed the court that representations had been made to the authorities, requesting two weeks to consider them and issue appropriate orders.

Justice Nagaprasanna directed respondents to review the representations according to the law and present findings on August 20. He noted the issue requires thorough examination and will remain pending.

Darshan and 15 others were arrested for the alleged murder of his fan, Renukaswamy, who reportedly sent obscene messages to Pavithra Gowda on social media.
