In a significant ruling, the Delhi High Court has restrained several imposter domains infringing on the trademark of Tata Power Solar Systems Limited. Justice Amit Bansal, who oversaw the case, emphasized the apparent infringement of Tata's registered trademarks, citing clear intent by the registrants to deceive consumers and exploit Tata's reputable brand.
The imposter domains — www.tatapowersolardealership.co.in, www.tatapowersolars.com, www.tatapowersolars.org, and www.tatapowersolarroof.com — were found to mimic Tata Power Solar's trademarks for identical solar energy services. The court labeled it a 'clear case of infringement,' acknowledging the defendants' failure to appear before the court.
A permanent injunction was granted, effectively halting the imposter domains' activities. While www.tatapowersolarroof.com was ordered to be suspended, it was reported to the court that the other two domains had already faced suspension.
