Meta Platforms Inc is contesting a Rs 10 lakh fine in the Delhi High Court, arguing it's inappropriate for the alleged unauthorized sale on Facebook Marketplace. The Central Consumer Protection Authority imposed the fine, citing unauthorized listings of walkie-talkies. Meta's senior counsels argue Facebook differs from typical e-commerce platforms like Amazon.
Arguing in court, senior advocate Mukul Rohatgi emphasized that Facebook Marketplace functions as a notice board rather than a commercial platform. Unlike Amazon or Flipkart, Facebook does not charge commissions or facilitate sales transactions, hence, the CCPA allegedly overstepped its jurisdiction.
Meta's petition insists that the Facebook Marketplace is a personal goods exchange for individuals, not a business platform. It claims CCPA's decision was excessive and misinterprets digital marketplace regulations. The court will next hear the case on March 25, providing Meta the opportunity to defend further.
