This law notably omits the CJI from the committee tasked with appointing the chief election commissioner and election commissioners.

The decision stemmed from CJI Surya Kant's acknowledgment of a potential conflict of interest, given his position. Thus, he proposed that a bench without any prospective Chief Justice oversee the matter to maintain objectivity.

The petitions, supported by Congress leader Jaya Thakur and the Association for Democratic Reforms, argue that the exclusion of the CJI compromises the selection process's independence.
