National Small Enterprise Amendment Bill Signed into Law to Transform Small Business Ecosystem

The legislation also establishes the Small Enterprise Development Finance Agency (SEDFA), which will offer customized support to MSMEs and cooperatives, promoting their strategic role in various economic sectors.

President Cyril Ramaphosa has signed the National Small Enterprise Amendment Bill into law, a move poised to significantly reshape the small business landscape in South Africa.

Minister of Small Business Development Stella Ndabeni-Abrahams expressed confidence that the amended National Small Enterprise Act will enhance support for small businesses, aiming to level the playing field and provide more integrated financial and non-financial assistance to Micro, Small, and Medium Enterprises (MSMEs) and cooperatives.

The new law introduces several key changes, including the establishment of the Office of the Enterprise Ombud Service, which will offer impartial mediation for disputes involving small enterprises. This measure is intended to provide a cost-effective alternative to litigation, which has often been a barrier to small business growth and sustainability.

Additionally, the Act redefines and simplifies the term "small enterprises" and grants the Minister the authority to declare certain trading practices as unfair. These measures aim to improve the operational environment for MSMEs by addressing practices such as exclusionary compliance requirements, retrospective contract changes, ambiguous terms, and unjustified terminations of commercial relationships.

The legislation also establishes the Small Enterprise Development Finance Agency (SEDFA), which will offer customized support to MSMEs and cooperatives, promoting their strategic role in various economic sectors.

"The Act addresses the lack of effective and affordable justice mechanisms for small enterprises," said Ndabeni-Abrahams. "Business-to-business disputes and issues like late payments have significant implications for the growth and sustainability of small enterprises. The new Ombud service will provide a binding resolution to these disputes, while still safeguarding constitutional rights through provisions for review on grounds of illegality, procedural unfairness, or irrationality."

The Act underscores the government's commitment to placing MSMEs at the heart of economic recovery and growth, streamlining support services, and fostering an inclusive economic environment.
