The Delhi High Court has dismissed contempt proceedings against a man embroiled in a bitter custody battle, accepting his apology following an outburst in trial court. The decision came after he agreed to pay Rs. 25,000 to the Delhi High Court Legal Service Committee.
During a hearing, the father used abusive language out of frustration arising from his separation from his son. A Division Bench comprising Justices Prathiba M Singh and Amit Sharma ordered the dropping of contempt charges, noting the father’s immediate expression of remorse and the challenging circumstances he was facing.
The High Court emphasized the necessity of dealing with such cases with empathy, particularly when the contemnor expresses genuine regret. They observed that while contemptuous behavior cannot be tolerated, the man's actions were the result of an emotionally charged moment rather than a deliberate attempt to disrespect the court.
