Umar Khalid Granted Interim Bail for Family Wedding Amidst UAPA Case Review

Umar Khalid, once a prominent student leader at Jawaharlal Nehru University, has secured interim bail to partake in his cousin's wedding ceremonies. The Karkardooma court sanctioned this bail for a limited period of seven days to permit his attendance. Currently, Khalid is held in judicial custody due to allegations tied to a significant conspiracy related to the 2020 North East Delhi violence, with the bail valid from December 28 to January 3.

The Delhi High Court is in the process of examining Umar Khalid's regular bail plea alongside co-accused activist Sharjeel Imam. Both are involved in a UAPA case that scrutinizes the purported extensive conspiracy behind the communal clashes that erupted in Delhi in February 2020. Khalid was apprehended by the Delhi Police's Special Cell on September 14, 2020, under the stringent Unlawful Activities (Prevention) Act for his supposed association in the case.

In his previous attempt for bail, the trial court ruled against him, referencing the High Court's appraisal of the prima facie nature of the charges, indicating that the restrictions under Section 43D(5) of UAPA were pertinent. Consequently, his application for bail was denied. The court emphasized that after the High Court dismissed his criminal appeal on October 18, 2022, and his subsequent petition withdrawal at the Supreme Court, the existing court order attained final status. Consequently, reevaluation or granting the relief he seeks is outside the trial court's jurisdiction, given the established legal conclusions.
