In a significant ruling, Delhi's Tis Hazari court has handed a ten-year prison sentence to an individual found guilty of abducting and raping a one-and-a-half-year-old girl in 2019. The verdict, delivered by Special Judge Manoj Jain (II), involves a decade-long imprisonment under Section 6 of the POCSO Act, alongside a Rs 1,000 fine.
Additionally, the convict received a three-year sentence under Section 363 of the IPC for kidnapping the minor victim, accompanied by another Rs 1,000 fine. The prosecution argued for maximum sentencing, considering the gravity of the crime against the young girl. The court emphasized the lack of leniency warranted in this case to serve as a formidable societal deterrent.
Furthermore, the court awarded the minor victim Rs 13.50 lakh in compensation, factoring in the severe physical and psychological trauma incurred. The decision included an assessment from the DLSA, and the court cited the enduring impact on the young girl's life, including a significant hospital stay. The sentencing reflects the court's commitment to Restorative and Compensatory Justice, despite the convict's plea for leniency based on personal circumstances.
