Nepal is grappling with a significant judicial crisis as the appointment process for the next Chief Justice has sparked a contentious face-off between the country's legislature and judiciary. The conflict, intensifying after officiating Chief Justice Sapana Pradhan Malla directed the Supreme Court to accept a writ challenging the Constitutional Council's Chief Justice recommendation, has brought underlying judicial divisions to light.
The writ, targeting the council's May 8 recommendation of Justice Manoj Kumar Sharma, contends that due constitutional procedures were bypassed, favoring Sharma, the fourth-ranked justice, over more senior candidates. Chief Justice Malla's insistence on the writ's registration by 1 PM met obstruction as key court administrative figures became unreachable, highlighting compliance and procedural issues within the judiciary.
