Expert Commends Transparency in Guatemala's Judicial Appointment Process

An independent expert has voiced approval for Guatemala's recent swearing-in ceremony of the Nominating Commissions responsible for judicial appointments, highlighting the importance of transparency and accountability in the selection process.

Margaret Satterthwaite, the Special Rapporteur on Independence of Judges and Lawyers, emphasized that all members of the Commissions must act responsibly and prioritize national interests as they prepare to nominate new judges for the Guatemalan Supreme Court and Court of Appeal, whose current magistrates' terms expire in October 2024.

"I call on the Nominating Commissions to publicly disclose the criteria and indicators used to assess candidates' suitability, including capacity, specialization, integrity, and proven reputation," stated Satterthwaite. "It's essential to establish a clear evaluation framework from the outset, outlining how each criterion will be scored and addressing any criteria for exclusion or acceptance of objections."

Satterthwaite stressed the importance of comprehensive evaluations for incumbent judicial officials, particularly in assessing their current performance independently. Regarding integrity criteria, she underscored that a clean criminal record alone is inadequate, advocating for sworn declarations of assets, employment history, and personal and commercial conflicts of interest to be mandatory.

"Civil society's active and meaningful participation in candidate evaluations and process monitoring is crucial," Satterthwaite added. "It's imperative to avoid delays in judicial appointments, which have plagued Guatemala previously. The Guatemalan people deserve a judiciary comprised of highly qualified judges appointed in a timely manner."
