Supreme Court Orders BMW India to Compensate Customer with Rs 50 Lakh for Defective Car
The Supreme Court has directed BMW India to pay Rs 50 lakh to a customer for a defective car supplied in 2009. The decision overturns a Telangana High Court order and mandates the payment by August 10, 2024. The car manufacturer had initially offered a replacement, but it was declined by the complainant.

The Supreme Court has ruled that BMW India Private Ltd must compensate a customer with Rs 50 lakh for supplying a defective vehicle in 2009. Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra set aside a previous Telangana High Court order, which had quashed the prosecution against BMW and ordered the delivery of a new vehicle.
The court directed BMW to pay the amount by August 10, 2024, through electronic transfer. This compensation will serve as the final settlement of all claims. The ruling also nullified the high court's order for vehicle replacement.
The court noted that BMW had offered a new vehicle in 2012, but the complainant refused. Instead, the complainant sought monetary compensation. Given the case's protracted history, the Supreme Court deemed a monetary settlement as the most just resolution.
