The Allahabad High Court has ruled that the 'no work-no pay' principle does not apply to reinstated Uttar Pradesh government employees who have been fully exonerated.

Justice Salil Kumar Rai, allowing a writ petition filed by Dinesh Prasad, clarified that Rule 54 of the Financial Hand Book Volume-II guarantees full pay for a dismissed employee exonerated from all charges after reinstatement. This period will be considered active duty.

The court emphasized that a reinstated government servant cannot be denied pay and allowances for the dismissal period unless they were gainfully employed during that time. The petitioner, a UP Police officer, was dismissed but later cleared of all charges and reinstated. The court ordered compliance with its ruling.
