Judge Shefali Barnala Tandon emphasized that special privileges for women should not be exploited to settle personal vendettas. She noted that false allegations can devastate the life, reputation, and social standing of the accused.
The case stemmed from a bail application by the accused, who was named in an FIR on July 14. The following day, the woman admitted to having consensual relations with the man, retracting her rape allegations. She later confessed to making the allegations in anger after a conflict, prompting the court to grant bail.
The judge underscored the problem of misuse of rape laws, observing that such false claims are increasingly common. She directed the police to pursue appropriate legal action against the woman and advised them to be cautious in making arrests based on unverified complaints. A compliance report is expected within 10 days.
