Delhi HC Dismisses Plea Challenging Aide's Arrest in Maliwal Assault Case

The Delhi High Court on Friday dismissed a plea filed by Bibhav Kumar, an aide to Chief Minister Arvind Kejriwal, challenging his arrest in connection with the alleged assault on AAP MP Swati Maliwal at the CM's residence.
Justice Neena Bansal Krishna delivered the verdict, stating, ''Petition dismissed.'' Kumar, who is currently in judicial custody, was accused of assaulting Maliwal on May 13 and was arrested on May 18.
Bibhav Kumar's plea argued that his arrest was illegal, citing gross violations of Section 41A of the Code of Criminal Procedure and legal mandates. However, the Delhi Police opposed the petition, asserting that Kumar was not hastily arrested and that his detention followed legal procedures.
The FIR against Kumar, filed on May 16, included various IPC provisions related to criminal intimidation, assault with intent to disrobe, and an attempt to commit culpable homicide. His bail request had been previously denied by the trial court and the high court, with the matter now pending before the Supreme Court.
