The Aam Aadmi Party is set to challenge the Supreme Court's decision regarding the lieutenant governor's authority to nominate aldermen to the MCD. According to party sources on Tuesday, AAP argues that this ruling poses constitutional issues and is detrimental to the nation.

Party insiders revealed that they are seeking legal advice to consider approaching a higher bench of the Supreme Court. 'This verdict undermines our democratic system. Regardless of our party's status, this is not beneficial for the country,' a senior party leader told PTI.

The Supreme Court, led by Chief Justice D Y Chandrachud along with Justices P S Narasimha and J B Pardiwala, had rejected the Delhi government's plea, asserting the LG is not bound by the council of ministers' advice in nominating 10 aldermen.

Sanjay Singh, a senior AAP leader, expressed respectful disagreement, stating the SC's ruling allows the LG to bypass the elected government. Meanwhile, an MCD official indicated they are studying the court's order, planning to hold elections for the 18-member standing committee once reviewed. The standing committee’s constitution had been stalled for 1.5 years due to this legal matter.

The election process involves Delhi Mayor Shelly Oberoi giving directives, which are forwarded to MCD commissioner Ashwani Kumar for final scheduling by the Municipal Secretary. Initial elections for ward committees will select 12 members each for the standing committee, followed by a House vote for six additional members.

The verdict represents a significant setback for AAP in the MCD, as it may lose its majority influence if BJP-backed members gain dominance in the standing committee. This could potentially lead to conflicts over financial proposals exceeding Rs 5 crore.
