India's Top Court Intervenes in Byju's and Cricket Board Settlement Case
India's Supreme Court ruled that the settlement application between Byju's and the Cricket Board should have been heard by the Company Law Tribunal. The top court deemed the Appeals Tribunal's ruling allowing the settlement as procedurally incorrect and set aside an order that quashed insolvency proceedings against Byju's.
India's Supreme Court has made a significant ruling regarding the settlement application between Byju's and the Board of Control for Cricket in India (BCCI). The court emphasized that the case should have been presented before the National Company Law Tribunal for better procedural handling.
The top court criticized the Appeals Tribunal ruling, which permitted a settlement between the educational technology company, Byju's, and BCCI. According to the Supreme Court, this ruling was made without following the proper procedural norms.
In a decisive move, the Supreme Court set aside the Appeals Tribunal's order, which had previously quashed insolvency proceedings against Byju's. This highlights the importance of adhering to procedural norms in business and legal settlements.
