Justice Prevails as Nandigram Murder Cases Revived

The Calcutta High Court has mandated the revival of ten criminal cases related to the Nandigram murders in 2007. The cases were previously withdrawn by the West Bengal government under Section 321 of the CrPC. The court deemed this withdrawal unlawful, emphasizing the need for zero tolerance towards violence.

The Calcutta High Court has ruled that accused individuals in ten murder cases connected to the 2007 Nandigram and Khejuri anti-land acquisition movement must face trial. The court has ordered the reinstatement of these cases, further criticizing the West Bengal government's 2020 decision to withdraw them as illegal.

In a judgement led by Justice Debangsu Basak, it was concluded that the prosecution's decision to pull back under Section 321 of the Criminal Procedure Code fails the legal framework and public interest, potentially condoning political violence, which goes against constitutional obligations.

The court stressed the need to eliminate societal violence, asserting that a democracy should reject all forms of violence irrespective of their timing. Authorities were directed to renew legal proceedings for these cases within two weeks of the judgment.
