Delhi High Court Upholds Charges Against Government Official in Rape Case

The Delhi High Court has denied a petition to quash charges against Premoday Khakha, a suspended Delhi government official accused of repeatedly raping a minor girl. Charges against Khakha's wife, Seema Rani, for causing the girl's miscarriage, and against his children for failing to report the crime, have also been upheld.
Justice Swarana Kana Sharma asserted that there was no legal flaw in the session court's decision to frame charges against Khakha under various sections of the IPC and POCSO Act. Khakha's defense, citing his vasectomy as a reason for dismissal of charges, was rejected by the court.
The court emphasized that vasectomy does not conclusively prove inability to impregnate, referencing documented cases of conception post-vasectomy. The case remains under trial with Khakha and his wife in judicial custody, while their children received anticipatory bail by the Supreme Court.
