The bench, consisting of Acting Chief Justice Sanjeev Prakash Sharma and Justice Sangeeta Sharma, approved the bail after assessing arguments from both Asaram's counsel and the prosecution. Asaram's legal team, led by Devdutt Kamat, argued that the 84-year-old's prolonged illness necessitated better medical treatment than available in jail.
Despite opposition from the Additional Advocate General Deepak Choudhary and the survivor’s counsel PC Solanki, the court's decision highlights ongoing tensions in the judiciary system over high-profile cases like Asaram's. Asaram, imprisoned since April 2018, had received interim bail multiple times prior, showing persistent challenges in balancing justice and humanitarian considerations.
