United Nations human rights experts have raised alarm over a series of regressive policy measures in Argentina, warning they could undermine four decades of global leadership in transitional justice and accountability for crimes committed during the country’s military dictatorship.

The warning comes as Argentina marks the 50th anniversary of the 1976 military coup, with experts cautioning that recent developments threaten hard-won progress on truth, justice, and memory.

A Global Model Now Under Strain

Since its return to democracy in 1983, Argentina has been widely regarded as a global benchmark in transitional justice, pioneering efforts to prosecute crimes against humanity and restore victims’ rights.

Key milestones highlighted by UN experts include:

  • The CONADEP truth commission

  • The landmark Trial of the Juntas

  • Prosecution of over 1,000 perpetrators of dictatorship-era crimes

  • Creation of the National Genetic Data Bank

  • Establishment of the National Commission for the Right to Identity

  • Restoration of identities of forcibly disappeared children

  • Development of memory sites and policies nationwide

“Although there have been oscillations and gaps, Argentina has made major progress in the fight against impunity,” the experts said.

However, they warned that this legacy is now facing rapid deterioration.

Concerns Over Institutional Rollbacks

The experts expressed deep concern over measures adopted since 2024 that appear to weaken the state’s role in accountability and human rights protection.

These include:

  • Reduced state involvement in investigating crimes against humanity

  • Restricted access to dictatorship-era archives

Particular concern has been raised over reports of potential pardons for military personnel convicted of serious human rights violations.

UN experts issued a strong warning:

  • Pardons for such crimes are prohibited under international law

  • Granting them would represent a major setback for accountability

  • It risks reviving impunity for atrocities committed during the dictatorship

“Argentina cannot make the same mistake again,” the experts said, urging authorities to reject any move toward clemency for those convicted of crimes against humanity.

Rise in Denialism and Disinformation

The experts also flagged a worrying increase in:

  • Public denial or minimisation of dictatorship-era crimes

  • Glorification of perpetrators

  • Stigmatisation of victims and human rights organisations

  • Efforts to discredit transitional justice policies

“Attempting to rewrite the past with denialist or revisionist narratives constitutes an alarming setback and a violation of human rights,” they said.

Legal Obligations Under International Law

The UN experts emphasised that Argentina is legally bound to uphold:

  • The right to truth

  • The right to justice

  • The right to reparation

  • The preservation of memory

  • Guarantees of non-repetition

“This is not optional,” they stressed.

The experts urged the Argentine government to take urgent steps to reverse the current trajectory, including:

  • Restoring dismantled institutions and policies

  • Reaffirming commitment to accountability

  • Ensuring full access to historical archives

  • Strengthening protections for victims and human rights defenders
