A Delhi court on Thursday overturned a magistrate's decision to take cognisance of a criminal defamation complaint by AAP leader Satyendar Jain against BJP MLA Karnail Singh. The special judge pointed out that the original magistrate's order failed to take into account the exceptions to defamation.
Special Judge Jitendra Singh emphasized that defamation law includes exceptions such as statements made in the public interest or in good faith about public figures. The incomplete consideration of these exceptions by the lower court was highlighted as grounds for reassessment.
