In a major legal and financial victory for the government, the National Highways Authority of India (NHAI) has successfully defended two high-value arbitration disputes linked to the Panipat–Jalandhar section of National Highway-44, safeguarding thousands of crores in public funds and reinforcing stricter contractual accountability in highway infrastructure projects.

The two arbitration matters together involved claims exceeding ₹8,375 crore raised by concessionaires against NHAI over issues including alleged termination payments, toll revenue losses, project delays, escalation costs, extension of concession periods and various compensation demands.

Following extensive hearings and examination of technical evidence, contractual provisions and expert submissions, the arbitral tribunal largely upheld NHAI's position and ultimately passed net awards in favour of the highway authority.

The outcome is being viewed as one of the most significant recent arbitration successes for NHAI amid growing efforts by the government to strengthen financial discipline and reduce legal liabilities in large infrastructure projects.

First Arbitration Case Involved Claims Exceeding ₹5,443 Crore

According to NHAI, the first arbitration proceeding involved claims worth more than ₹5,443 crore raised by the concessionaire under the Concession Agreement governing the Panipat–Jalandhar highway project.

The claims primarily related to:

  • Alleged loss of toll collection revenue

  • Claimed loss of business opportunity

  • Termination payment demands

  • Change-of-scope disputes

  • Financial compensation claims

The concessionaire argued that it was entitled to substantial payments arising from alleged contractual and operational issues linked to the project.

However, NHAI strongly contested the claims, maintaining that the contractual termination was fully valid and attributable to deficiencies and defaults on the part of the concessionaire itself.

Tribunal Rejects Major Claims Against NHAI

After detailed adjudication and examination of contractual records, the arbitral tribunal rejected most of the major monetary claims raised against NHAI.

The tribunal also accepted several counterclaims and legal defences advanced by the Authority concerning:

  • Contractual breaches

  • Failure to meet project obligations

  • Expenditure liabilities

  • Performance deficiencies

Following adjustments of claims and counterclaims, the tribunal passed a net award of approximately ₹115.73 crore in favour of NHAI, along with applicable interest.

The ruling significantly reduced potential public financial exposure that could have arisen had the concessionaire's claims been accepted.

Second Arbitration Matter Involved Nearly ₹2,932 Crore Claims

In the second arbitration dispute, the claimant sought compensation exceeding ₹2,931.79 crore related to alleged execution delays and project-related financial impacts.

The claims included demands linked to:

  • Delay-related losses

  • Escalation costs

  • Prolongation expenses

  • Idling costs

  • Other project execution impacts

NHAI opposed the claims by arguing that the concessionaire lacked contractual entitlement and had failed to provide sufficient evidence supporting the financial demands.

The Authority also pointed to:

  • Non-compliance with contractual procedures

  • Failure to establish causation

  • Inadequate documentation

  • Weak evidentiary support

Tribunal Again Rules Largely in Favour of NHAI

After reviewing submissions from both parties, the tribunal substantially rejected the claims advanced against NHAI and upheld several major counterclaims filed by the Authority.

Following adjustment and set-off calculations, the tribunal awarded a net sum of approximately ₹704.23 crore in favour of NHAI.

The outcome represents another significant financial and legal success for the Authority in defending public infrastructure funds against large compensation demands.

NHAI also highlighted a recent arbitration success involving the six-laning project of the Kamrej–Chalthan section of NH-48 in Gujarat.

In that matter:

  • The contractor had raised claims worth approximately ₹174.49 crore

  • The arbitral tribunal ultimately awarded only ₹54 lakh to settle the dispute

Officials said the outcome once again demonstrated NHAI's focus on rigorous contractual defence and prudent financial management.

The Panipat–Jalandhar section forms part of NH-44, India's longest national highway and a strategically critical economic corridor connecting northern states with major industrial, agricultural and logistics hubs.
