In a significant legal development, the Supreme Court on Monday granted bail to Syed Iftikhar Andrabi, a man accused of drug trafficking and terror financing in a high-profile case in Jammu and Kashmir. The decision by Justices BV Nagarathna and Ujjal Bhuyan reasserted that bail is the legal norm, even under the stringent provisions of the Unlawful Activities (Prevention) Act (UAPA).
The court emphasized that indefinite incarceration cannot be justified under Section 43D(5) of the UAPA, aligning with its 2021 ruling in the KA Najeeb case. This decision came after Andrabi, a resident of Handwara, challenged the High Court of J&K and Ladakh's earlier dismissal of his bail plea.
The National Investigation Agency (NIA) alleges Andrabi's involvement in cross-border heroin smuggling with links to terrorist organizations like Lashkar-e-Taiba. This case, dating back to 2020, highlights the court’s stance on maintaining the balance between legal procedures and fundamental rights, particularly regarding the presumption of innocence.
