The Allahabad High Court has ruled Prakash Singh, District Inspector of Schools in Ghazipur, guilty of contempt for failing to fulfill a four-year-old order to pay an employee's salary. Justice Kshitij Shailendra emphasized the non-negotiable nature of judicial directives and the backlog faced by courts.
Rejecting Singh's request to delay proceedings due to a pending application for staying the order, Justice Shailendra defended the rule of law and judicial dignity. The court expressed concern over the staggering number of cases judges face daily, asserting that judicial commands must not be dismissed as optional.
The contempt arose from Radhey Shyam Yadav's 2017 petition, which saw a directive in April 2022 to ensure salary payment during its pendency - a directive not followed. Justice Shailendra remarked on the unrealistic expectations for overburdened judges and warned against lawlessness from disregarding court orders.
The court highlighted the necessity of maintaining public confidence in the judiciary through strict enforcement of its rulings, cautioning against threats to constitutional governance.
