The Delhi High Court has dismissed a Public Interest Litigation (PIL) contesting the government's notification to designate June 25 as 'Samvidhan Hatya Divas' (Constitutional Murder Day). The court, led by Acting Chief Justice Manmohan and Justice Tushar Rao Gedela, ruled that the notification does not violate or disrespect the Constitution.
While passing the order, the bench noted that phrases like 'murder of democracy' and 'mother of democracy,' commonly used by politicians, had no bearing on their decision. The court emphasized it would not be influenced by political rhetoric in this case.
The petitioner, Sameer Malik, argued that the notification dated July 12, 2024, violated constitutional provisions and the Prevention of Insults to National Honour Act, 1971. Represented by Advocate Ankit Borker and alongside Advocates Alok Singh and Samridh A. Sharma, Malik sought to quash the notification, considering it unconstitutional. The plea highlighted that the emergency declared on June 25, 1975, was under constitutional provision and thus, the date should not be marked as 'Samvidhan Hatya Divas.'
