The National Company Law Appellate Tribunal (NCLAT) has dismissed two petitions filed by Vedanta Limited, which challenged the acceptance of Adani Enterprises' bid for the heavily indebted Jaiprakash Associates Ltd (JAL). The tribunal's decision supports the commercial judgment exercised by the Committee of Creditors, despite Vedanta's claim that its higher bid was unfairly disregarded.

The tribunal, led by Chairperson Ashok Bhushan, reiterated that no substantial grounds were presented by Vedanta to question the adjudicating authority's decision. With no identified procedural missteps by the Resolution Professional during the resolution process, NCLAT found no merit in Vedanta's appeal.

Vedanta's plea, which pointed to its superior bid value, was also dismissed by the tribunal, emphasizing that the resolution plan approval relied on various factors beyond just financial metrics. Creditors defended their choice, noting the adherence to Insolvency and Bankruptcy Code rules and highlighting that bids were assessed on elements such as cash offered upfront, feasibility, and execution potential.
