Jaipur Developer Seeks SC Intervention Against Unauthorised Commercial Use of Residential Land

A Jaipur real estate firm has petitioned the Supreme Court seeking intervention against unauthorised commercial activities on its residential land. The firm claims that furniture outlets, boutiques, and eateries are operating illegally and urges action from Jaipur Municipal Corporation. A Jaipur private real estate company has taken its complaints to the Supreme Court over alleged unauthorised commercial activities occurring on land designated for residential use. The firm is demanding that the Jaipur Municipal Corporation (Greater) investigate and act according to law. This move comes as part of the pending case Loganathan vs State of Tamil Nadu & Ors., where earlier this year the court ordered municipal bodies across state capitals to identify and report commercial use within residential zones.

Rajdarbar Pinkcity Developments Pvt. Ltd., the company filing the application, is pushing to include its dispute under the Supreme Court's current investigation into the unauthorised commercialisation of residential areas. The developer alleges that commercial activities by furniture stores, boutiques, and eateries are breaching the residential-only stipulation on land in Chimanpura, Bhankrota. The company believes it holds particular development rights acknowledged by the Jaipur Development Authority in 2005 but claims little has been done to halt these activities despite legal appeals.

January 2025 saw the developer approach the JDA Appellate Tribunal, prompting an inspection directive in May of the same year if illegal structures were found. Although the Rajasthan High Court directed city officials to address the company’s concerns by February 2026, the developer asserts that no resolutions have been communicated and is contemplating further legal options. In addition to seeking the Supreme Court's attention, an application has been made for the Jaipur Municipal Corporation (Greater) to report the land in question, pursuant to March's Supreme Court order, and to address any unauthorised commercial practices present.
