The Bombay High Court on Friday ruled there were no legal flaws in the arrest of advertising firm director Bhavesh Bhinde, the main accused in the Ghatkopar hoarding collapse case. Bhinde had challenged his arrest, labeling it illegal and attributing the incident to an 'act of God.'
A division bench of Justices Bharati Dangre and Manjusha Deshpande rejected Bhinde's plea, asserting that the police had adhered to all proper legal procedures. The judges highlighted that the procedural safeguards, recognized by the Constitution and crucial to citizen liberty, were fully observed.
The court emphasized that Bhinde's arrest followed constitutional safeguards and the Code of Criminal Procedure. It dismissed claims of his rights being violated under Article 22, which ensures arrested individuals are informed of reasons for their arrest, allowed access to a lawyer, and produced before a magistrate within 24 hours.
