The controversy involves three children and a pregnant woman, dubbed 'illegal immigrants' by the Indian authorities. A Bangladesh court identified them as Indian citizens and urged their repatriation.

The Ministry of Home Affairs challenged this order in the Supreme Court, arguing jurisdiction issues as the original detention and deportation were executed in Delhi, highlighting procedural discrepancies.
