Nine protesters, initially granted bail in connection with a scuffle case, are facing renewed legal challenges after fresh arrests were made over the alleged use of pepper spray on police during demonstrations at India Gate. The new judicial custody orders have sparked a debate on legal grounds.
The Delhi courts initially sent these individuals to bail citing a lack of necessity for further custodial detention. Judicial Magistrate Sahil Monga had stated that reasonable conditions would suffice to prevent any evidence tampering or absconding, negating the need for extended incarceration.
Despite bail, 15 of the 17 protesters have been re-arrested, sparking accusations from defense counsel about the legality and procedure of these arrests. The defense argued the lack of communication regarding arrest grounds, raising concerns about due process.
