The Gauhati High Court has overturned the detention of AIUDF MLA Aminul Islam, citing procedural lapses in the detention order. Justice Kalyan Rai Surana and Justice Rajesh Mazumdar ruled in favor of Islam, who was arrested for making incendiary statements that allegedly threatened public order.
Islam was originally detained in April under sedition charges after his remarks about the Pahalgam and Pulwama attacks. His comments during the panchayat poll campaign went viral, drawing criticism for allegedly fueling communal tensions. The AIUDF distanced itself from his statements, asserting they were not reflective of the party.
The High Court highlighted the failure of authorities to inform Islam of his rights to represent against the detention order both to the detaining authority and the central government promptly. This oversight led to quashing the detention, with the court stating it did not need to examine further points from Islam's legal defense.
