The Allahabad High Court has denied a petition to quash criminal proceedings against a teacher accused of maintaining a decade-long sexual relationship with a student under false pretenses of marriage. The teacher, already married, is alleged to have deceitfully promised marriage, breaching Section 69 of the Bhartiya Nyaya Sanhita.
Justice Avnish Saxena ruled that the accused, aware of his existing marital status, engaged in a relationship that involved deceit, as he initially promised marriage yet never intended to fulfill it, thus constituting deceitful means as defined by the law.
The victim filed an FIR in June 2025 in Aligarh after discovering the accused's true marital status, including having three children. Despite his claims of a consensual relationship since 2014, the court noted the accused's implausible promise of marriage. The case highlights serious allegations of coercion, emotional, and physical abuse.
