High Court Slams Advocate for Vexatious Maintenance Case

The Allahabad High Court dismissed a petition by an advocate seeking expedited maintenance proceedings against his wife, labeling the case as vexatious and deceitful. The court fined the petitioner Rs 15 lakh for hiding key facts and exploiting his wife's loans for personal indulgences, directing payment as compensation.

The Allahabad High Court recently dismissed a petition filed by an advocate demanding an expedited decision on a maintenance case against his wife, calling the litigation 'vexatious' and 'based on pretenses'. Justice Vinod Diwakar criticized the petitioner for concealing important facts and imposing financial strain on his wife.

The court imposed a Rs 15 lakh compensatory cost on the petitioner, who is a practising advocate, for misusing funds borrowed by his wife to finance his lavish lifestyle, including purchasing alcohol. The petitioner failed to mention a prior maintenance order favoring him and misappropriated two substantial personal loans taken in his wife's name.

The court ordered that the petitioner pay the compensation within six weeks or face recovery actions by the district magistrate. Furthermore, an investigation into the petitioner's assets will be conducted following the court's ruling.
