High Court Boosts Pension Hopes for HAL Retirees

The Allahabad High Court has ruled in favor of higher pension benefits for HAL retirees, rejecting EPFO's salary caps. The court held that contributions on actual salaries entitle employees to greater pensions, overriding HAL trust rules. This decision enforces employee rights under the Employees' Pension Scheme, 1995.

In a significant judicial decision, the Allahabad High Court has ruled in favor of retired employees from Hindustan Aeronautics Limited (HAL) seeking higher pension benefits. The court dismantled prior rejections from the Employees' Provident Fund Organisation (EPFO), emphasizing employees' rights to pensions based on actual salaries rather than imposed ceilings.

The court decision, delivered by Justice Shree Prakash Singh, nullified previous orders denying HAL employees’ joint option forms. The judgment took into account contributions made by both the employer and employees to the pension fund, which were calculated on actual salaries. By defying the Rs 6,500 salary limit set by HAL Trust Rules, the court affirmed a more favorable interpretation favoring employees.

HAL's management consented to higher pension benefits, mirroring Supreme Court precedents that recognize such rights. Consequently, the regional provident fund commissioner has been instructed to re-evaluate employees' pension options, ensuring compliance with statutory provisions and safeguarding the financial security of retirees.
