The Delhi High Court has dismissed a public interest litigation challenging the tax exemption granted to agricultural income. The court labeled the request as 'misconceived,' stating that such legislative actions are beyond its jurisdiction.
The petitioner, Aakash Goel, argued that this exemption led to fiscal inequality by arbitrarily classifying taxpayers, especially benefiting affluent individuals deriving agricultural income.
While some states like Assam and West Bengal effectively levy taxes on certain agricultural incomes, Delhi lacks such legislation entirely, making income from agriculture in the National Capital Territory tax-free.
