The Delhi High Court has turned down a public interest litigation questioning the President's decision to nominate BJP figure C Sadanandan Master to the Rajya Sabha. The case focused on whether the appointment adhered to constitutional provisions.
Justices D K Upadhyaya and Tejas Karia highlighted that Article 80(3) of the Constitution grants the President authority to nominate members with recognized expertise in various disciplines. The court found no reason to question the President's discretion in this matter. The petition had argued that Master's political links influenced his nomination; however, the court dismissed these claims as speculative with insufficient evidence to suggest he lacks qualifications.
The ruling emphasized that the breadth of Article 80(3) encompasses nominees with political backgrounds as long as they also have relevant expertise in fields such as social service. The court concluded that there was no substance in the allegations, thereby affirming the President's nomination of Sadanandan Master.
