UN Torture Expert Accuses Israel of Systemic Abuse of Palestinian Detainees

A United Nations expert has accused Israel of permitting widespread torture, sexual violence, and degrading treatment against Palestinian detainees following the 7 October 2023 attacks, warning that the scale and severity of allegations point to a systemic failure to uphold international law and basic human rights.
In a newly released communication to Israeli authorities, UN Special Rapporteur on torture Alice Jill Edwards said emergency detention measures introduced after October 2023 exposed Palestinian detainees to severe abuse, incommunicado detention, degrading treatment, and potentially unlawful deaths in custody.

UN Expert Raises Alarm Over Detention Conditions
Alice Jill Edwards, the UN Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment, said the allegations collected indicate "gross disregard" by Israel of its obligation to treat detainees humanely and without discrimination.
According to the communication, the UN investigation documented:

52 incidents involving torture or other forms of ill-treatment

33 incidents involving sexual torture or sexualized abuse
Many detainees reportedly experienced multiple forms of abuse simultaneously.
The Israeli Government had not submitted a response to the UN communication at the time the findings became public.
Allegations Include Severe Physical Abuse
The Special Rapporteur described a wide range of alleged abuses inside Israeli detention facilities.
Reported methods of torture and mistreatment included:

The UN expert stated that such treatment may constitute violations of the Convention against Torture as well as international humanitarian law.
Sexual Violence Allegations Highlighted
The communication places particular emphasis on allegations of sexual torture and degrading sexual abuse.
Among the reported incidents were:

One case involving repeated anal and vaginal rape

Two cases involving rape with objects

Multiple allegations involving beatings, electrocution, and attacks by dogs directed at detainees' genitals
The report also documented humiliating strip searches and sexual intimidation of both male and female detainees.
Eleven male detainees reportedly described abuse involving their genital areas, including assaults by dogs and electrocution.
Edwards described the testimonies as "deeply distressing" and stressed that every allegation involved individuals entirely dependent on those exercising authority over them.
Concerns Over Deaths in Custody
The report expressed serious concern over at least 94 deaths in Israeli custody since October 2023.
According to the Special Rapporteur:

Many of the deaths have not been independently investigated

Some post-mortem examinations revealed evidence consistent with severe violence
Reported findings included:

Impunity Concerns Raised
The Special Rapporteur criticized what she described as serious shortcomings in Israeli investigative mechanisms.
The report stated that:

1,680 complaints filed against Israeli intelligence services had resulted in no indictments

Only a small number of cases investigated by military authorities had progressed further
Edwards specifically requested clarification regarding a March 2026 decision by Israel's Military Advocate to drop charges in a case involving the alleged rape of a Palestinian detainee.
She warned that the lack of accountability reinforces concerns that impunity is widespread.
International Law Prohibits Torture Under All Circumstances
The Special Rapporteur reminded officials that torture is prohibited under international law without exception.
She emphasized that:

Torture is an international crime

No amnesties or immunities are permitted

"Superior orders" cannot be used as a defence
Edwards warned that officials at every level may bear individual responsibility for violations committed under their authority.
Thousands of Palestinians Held in Detention
At the time of the communication, more than 9,000 Palestinians were reportedly being held in Israeli detention facilities.
According to the report:

Around 40 percent were held under administrative detention

Approximately 3,200 detainees were Palestinians from the West Bank
-
Around 1,300 Gazans were held as "unlawful combatants"

Roughly 2,200 were convicted prisoners
Administrative detention allows individuals to be held without formal charges or trial for extended periods under Israeli security laws.
Human rights groups have long criticized the practice, particularly regarding its use against Palestinians.
UN Calls for Fair Trials and Release of Arbitrary Detainees
The Special Rapporteur reiterated her call for:

The release of Palestinians arbitrarily detainedor

Their prompt prosecution through fair legal proceedings
She stressed that all detainees must receive legal protections consistent with international law and due process standards.
Concern Over Proposed Death Penalty Law
The report also raised alarm about a proposed Israeli death penalty law that the UN expert warned could disproportionately target Palestinians.
Human rights organizations have previously expressed concern that expanded capital punishment measures could intensify discrimination and further politicize the justice system.
Investigation Expanding Beyond Israel
The Special Rapporteur also announced the launch of a separate examination into alleged torture and abuses committed by:

The Palestinian Authority in the West Bank
Edwards said accountability must apply to all actors involved in abuses committed since 7 October 2023.
