A U.S. judge on Monday dismissed the criminal case accusing Donald Trump of illegally holding onto classified documents, marking another major legal victory as the former president seeks a return to the White House.

Florida-based U.S. District Judge Aileen Cannon, nominated by Trump, ruled that Special Counsel Jack Smith, leading the prosecution, was unlawfully appointed and lacked authority to bring the case. This decision follows a July 1 U.S. Supreme Court ruling granting Trump immunity from prosecution for many actions taken during his presidency.

Prosecutors are likely to appeal the ruling. Other courts have upheld the Justice Department's ability to appoint special counsels for politically sensitive investigations. However, Cannon's ruling places the future of the case in doubt, though Smith is still prosecuting Trump in another federal court over attempts to overturn the 2020 election.

In the documents case, Trump was indicted for willfully retaining sensitive national security documents at Mar-a-Lago and obstructing government efforts to retrieve them. Trump's lawyers challenged the legal authority of Attorney General Merrick Garland's 2022 decision to appoint Smith, arguing it violated the U.S. Constitution.

Judge Cannon's decision is the latest in a series favoring Trump's defense. She previously delayed the trial indefinitely and allowed three outside lawyers to argue in court, including two who sided with Trump.

Conservative Supreme Court Justice Clarence Thomas also supported Trump’s challenge. In his opinion, agreeing with granting Trump broad immunity in the election case, Thomas questioned Smith's appointment's legality. Garland appointed Smith to ensure investigations into Trump remained independent from the Biden administration's Justice Department.
