High Court Upholds Right to Criticize in Parliamentary Democracy

In a significant ruling, the Allahabad High Court on Friday dismissed a petition to file an FIR against Congress leader Rahul Gandhi over an alleged controversial remark in 2025, made at the inauguration of the All India Congress Committee office.

Justice Vikram D Chauhan reiterated the importance of criticism in a parliamentary democracy, stating that differing ideological views do not constitute an offence. This decision arose from a legal challenge by Simran Gupta, following the rejection of her plea for an FIR by a Sambhal court.

The court noted that no evidence suggested the alleged statement endangered India's sovereignty, unity, or integrity. Gupta's assertions lacked material support, deemed based on suspicion and imagination rather than concrete evidence.
