The Ministry of Health and Family Welfare has introduced a regulatory change that will bring the sale of cough syrups under stricter oversight across rural India. Through a recent amendment to the Drugs Rules, 1945, the government has withdrawn an exemption that previously allowed cough syrups to be sold in certain villages without the need for licensed retail pharmacy arrangements.

The amendment was notified through Gazette Notification G.S.R. 927(E) dated December 29, 2025, and published in the Gazette of India Extraordinary on December 30, 2025. The change removes the word "Syrup" from Entry 7 under Serial No. 13 of Schedule K of the Drugs Rules.

Exemption for Cough Syrups Withdrawn

Schedule K of the Drugs Rules lists specific categories of medicines that are exempt from certain provisions of the Drugs and Cosmetics Act, 1940, and related rules. Under the earlier framework, cough syrups could be sold in villages with populations below 1,000 without complying with some retail licensing requirements.

With the latest amendment, cough syrups will no longer enjoy this exemption. Their sale and dispensing will now be permitted only through properly licensed pharmacies, regardless of the size of the village where they are being sold.

The change means that rural consumers seeking cough syrup medicines will need to obtain them from outlets that meet the licensing requirements prescribed under existing drug laws.

The government has stated that the amendment is intended to strengthen oversight of syrup-based formulations and bring the exemption framework in line with current public health and safety priorities.

The amendment is expected to create a more uniform regulatory framework for cough syrup sales across the country while strengthening safeguards for consumers. Health authorities believe the measure will support safer access to medicines and improve accountability within the pharmaceutical distribution network.
