High Court Stays Suspension of Homeguard Commandant Accused of Immoral Conduct

The Allahabad High Court has paused the suspension of Homeguard Commandant Manish Dubey, who was accused of immoral conduct. Allegations made by a sanitation worker, Alok Maurya, against Dubey were deemed vague by the court. Dubey’s suspension, imposed on November 7, 2023, has been stayed, allowing him to resume his duties.

The Allahabad High Court has intervened to stay the suspension of Homeguard Commandant Manish Dubey, following allegations of immoral conduct. The court found the charges against him to be vague and insufficient to justify the suspension.

The allegations were raised by Alok Maurya, a sanitation worker, who claimed that his wife, SDM Jyoti Maurya, was involved in an illicit relationship with Dubey. Despite these accusations, the court emphasized that Dubey's private life does not directly interfere with his professional duties.

Justice JJ Munir directed the state government to respond within three weeks and scheduled the next hearing for August 27, 2024. Dubey has been allowed to resume his duties, and his salary will continue to be paid. The court's decision highlights the need for clear evidence when imposing suspensions.
