The Supreme Court has directed the National Green Tribunal (NGT) to monitor the impact of silicosis-prone industries across India, ensuring that both the Central Pollution Control Board and state pollution control boards adhere to prior directives.
Silicosis, an incurable lung disease caused by inhaling silica dust, remains a significant occupational hazard. Justices Vikram Nath and Prasanna Bhalachandra Varale emphasized that statutory bodies are best positioned to oversee regulatory compliance.
The court also tasked the NGT with taking additional steps to curb the spread of silicosis in the industrial sector.
Moreover, the court highlighted the necessity of timely compensation for affected workers or their next of kin, assigning the National Human Rights Commission (NHRC) to oversee this process. The Employees' State Insurance Corporation and state chief secretaries are to support the NHRC in ensuring swift and efficient compensation distribution.
The Court directed its registry to send all relevant reports and affidavits to the NGT and NHRC to streamline their responsibilities.
This directive came in response to a plea by NGO People's Rights and Social Research Centre, which highlighted the widespread issue of silicosis and the violation of workers' fundamental constitutional rights.
